Warranty Service
1. General conditions
1.1 This contractual limited warranty is provided voluntarily by the seller (manufacturer), without being required by law. Therefore, this contractual warranty and its terms of application (service) only supplement, but do not change or limit, the buyer’s rights defined by law.1.2 The quality of the product (conformity with the contract) is not the subject of this warranty service; that is, neither the manufacturer nor the seller guarantees that the device will operate without errors or interruptions.1.3 MB Variantai bears no responsibility for damage that occurred because the user failed to follow the instructions and recommendations of the device’s manufacturer or seller.1.4 This warranty service does not apply to software or consumables and is not provided if:• The device was used incorrectly, not for its direct purpose, the manufacturer’s permitted device loads (resources, ratings) were exceeded, or operating modes were impermissibly overclocked;• Failures or defects arose through the fault of the Buyer or third parties, catastrophic natural phenomena or force majeure circumstances;• Failures arose from the Buyer using consumables or product parts that are not original or recommended by the product’s manufacturer;• The device is mechanically, thermally, chemically or otherwise damaged;• The failure arose from contamination, where dust, foreign objects, materials, liquids, insects or the like entered the interior of the device;• The device model, serial number, warranty or other stickers or markings on the devices are damaged, destroyed or altered;• The device was connected to technically faulty or unearthed electrical, telephone or other networks, or the failure arose from excessive voltage or voltage surges, a sudden voltage drop or outage (whether or not through the Buyer’s fault);• Several devices were interconnected without following the device interconnection rules;• The failure arose from improper servicing of the equipment or from another failure (failing to contact the service centre in time and continuing to use the faulty product);• The failures arose from viruses or other malicious programs or a software failure;• Any repair, diagnostics or modification of the device was carried out independently (not by the seller’s or manufacturer’s technical centre), or there are signs of attempts to open the product, and the like.1.5 The presence of dead pixels on the LCD screens of monitors, laptops and tablets, cameras, phones and other devices is not considered a failure or defect if the number of pixels does not exceed the dead-pixel standards set by the device’s manufacturer.1.6 The seller and the manufacturer bear no responsibility for damage to or loss of data on the device’s storage media, or for any information on the device and its legality. Before handing the device over for servicing, it is necessary to make copies of all data and remove all confidential information from the device’s storage media, as all data on the device may be lost during servicing.1.7 The Buyer must keep the Warranty certificate and all documents accompanying the goods (original manufacturers’ warranty cards, instructions, individual device manuals, etc.) and the original product packaging until the end of the warranty period of the product or its components.1.8 Natural wear of the product during its use, or a resulting change in its appearance or properties, is not considered a product failure or quality defect.
2. Seller’s liability
2.1 In the event of a device failure, the seller’s maximum liability is determined by the value of the repair or replaced device components (which caused the failure), limited by the manufacturer’s warranty service.2.2 The seller bears no responsibility for losses arising from equipment failures, including lost profit, time, or unintentional consequential losses.2.3 The warranty service period set by the manufacturer defines the period of time from the moment of purchase of the device during which failures occurring in the device will be remedied at the expense of the manufacturer or its authorised representatives under these service conditions. The manufacturer’s warranty service period and the purchase date are indicated in the device’s warranty certificate.2.4 Warranty service is performed only before the expiry of the manufacturer’s warranty service period, by handing the equipment over to the manufacturer or its representative. The technical centres authorised by the manufacturer or its representatives (ATCs) are indicated in the warranty certificate.
3. Warranty service conditions
3.1 Warranty repair is performed in the Seller’s warranty repair (service) department or at the Manufacturer’s authorised technical centre (ATC). The Buyer delivers and collects the product for repair using their own means and at their own expense, except in cases provided for by the legal acts of the Republic of Lithuania. Where the warranty service of the product is performed by an ATC and the device is delivered to the Seller’s service department, the Seller refers the Buyer to the ATC or, with the buyer’s consent, provides an intermediation service for a set fee (transportation, administration). Invoices issued by the ATC for non-warranty services are paid by the Buyer.3.2 Warranty repair is performed only upon the Buyer presenting:• a duly completed Seller’s product warranty certificate or duly completed original manufacturers’ warranty cards;• the product purchase document (invoice, receipt, payment slip or acceptance–handover deed).3.3 When submitting a device for warranty service, all bundled accessories must also be submitted. Products that use consumables (e.g., printers, copying and similar devices) must be submitted with non-empty original consumables or consumables recommended by the manufacturer (e.g., ink or toner cartridges).3.4 Accessories not included in the bundle (memory or SIM cards, cases and the like) must be removed before submitting the device for servicing; the Seller and the ATC are not responsible for the safekeeping of such accessories. When devices (phones, tablets) are submitted for warranty service with protective glass or films applied, the Seller or the ATC may require the protective glass or films to be removed.3.5 If the device is protected by a password or other means, these are removed without coordination. If this is impossible and the client refuses to unlock the device, the device’s warranty service is not performed and the device is returned.3.6 For naturally wearing, consumable materials, printer heads, toner cartridges, processor, power-supply, cooler and other fans, batteries and accumulators, chargers and bundled accessories, a shorter warranty period than for the main device applies, which is indicated in the product description or warranty certificate. Where such a period is not separately indicated, the manufacturer’s warranty service does not apply to the devices indicated in the certificate or card, and defects are remedied only in the manner provided for by the legal acts of the Republic of Lithuania.
4. Procedure and time limits for warranty repair
4.1 The Buyer must submit the product for warranty repair in the manufacturer’s packaging or analogous packaging ensuring safe transportation, with the documents received at the time of purchase, drivers, bundled cables, wires and software.4.2 When submitting the product, the Buyer must specifically and clearly indicate the observed failure, defect or other reason for which the product is being submitted for repair.4.3 When accepting a product for warranty service, a preliminary inspection of the product is performed. Significant damage to the product noticed visually or otherwise during this inspection is recorded in the Device acceptance-for-repair certificate or in a separate deed. Upon submitting the product or its part for detailed inspection at the ATC, hard-to-notice or hidden damage not identified during the preliminary inspection may be discovered.4.4 The initial diagnostics of the product is performed within 3 (three) working days. During this diagnostics, it is determined whether the defect indicated by the buyer exists (manifests itself). If the Seller does not have the technical capability to perform the initial check on the Seller’s premises, the product is submitted to the ATC. In that case, identifying the failure and/or its cause may take up to 10 (ten) working days.4.5 If the failure of the product or its part indicated by the Buyer manifests itself, or the initial diagnostics is not performed on the Seller’s premises, the Seller hands over (dispatches) the product to the ATC within 5 working days. If no failures of the Product are found, the non-conformity recorded by the Buyer is not considered a failure or defect, the existing failure occurred not through the manufacturer’s fault, or in the non-warranty cases specified in these conditions, the costs related to identifying the failure (diagnostics, transportation, invoices issued by the ATC, etc.) are covered by the Buyer. The product is returned to the Buyer only after full payment of the said costs.4.6 Upon receiving the product and recognising the failure as covered by warranty, the ATC repairs the product or its part (or, if repair is impossible, replaces it with another identical or analogous one) within 20 (twenty) working days from the submission of the product to the ATC, or within 30 working days if a part necessary for the warranty repair must be delivered from abroad, or if the manufacturer’s authorised technical centre is outside Lithuania.4.7 If the ATC or the Seller cannot fulfil the said warranty obligations, the Purchase–Sale agreement under which the product was acquired must be terminated and the money paid for the product must be refunded to the Buyer within 14 days.4.8 When collecting the product, it is necessary to check whether the indicated failure has been remedied (except where this cannot be done on the Seller’s premises), and also to make sure that the complete set of the device brought in for repair is returned. Claims regarding missing parts of the set are not accepted later. The product is not returned without the document (the product acceptance–handover deed). If the deed is lost, an identity document must be presented.4.9 When an unrepairable device or its component is replaced with another or an analogous one, no new warranty service period is granted for the replaced part — a continued warranty applies, as set for the device or its component submitted for warranty repair.4.10 The client must collect their device within 14 days from the dispatch of the notice of completion or suspension of warranty service (upon refusal to provide the necessary accessories or information) to the contacts indicated in the repair deed. If the device is not collected within the specified period, a product storage fee applies (1% of the product’s value for each day of delay). If the product is not collected within 100 days from the day the storage fee begins to accrue, MB Variantai has the right to stop storing the device and to dispose of it.
5. Other conditions
5.1 The Seller assumes no liability for any damage — direct, indirect, incidental or consequential as losses, including economic and material losses, loss of profit, income or information data — where they are related to defects in the goods sold by the Seller or the inability to operate the goods.
