1. General provisions
1.1. The website www.variantai.lt (hereinafter — the Website) is owned and administered by MB Variantai (company code: 306133252; registered office: Dailidžių k. 7, Trakai district) (hereinafter — VARIANTAI.LT).1.2. This Privacy Policy is a written document setting out the privacy provisions (hereinafter — the Privacy Policy) that apply to all persons using the Website and the Services. The terms used in this Privacy Policy have the meanings defined in the Website Terms of Use (hereinafter — the Terms) (use of the Website, Service, etc.), except where certain terms are separately defined in this Privacy Policy.1.3. This Privacy Policy is an information document: it explains how VARIANTAI.LT processes personal data, and it is not a contract the Visitor has to accept. Using the Website is not treated as consent to the processing of personal data — data is processed only on the legal bases set out in point 2.3.2, and where consent is required, VARIANTAI.LT asks for it separately and it can be withdrawn at any time.1.4. VARIANTAI.LT may update this Privacy Policy, for example when the ways in which data is processed or the applicable legislation change. The current version is always published on the Website and the date of its last update is stated at the beginning of this document, so we recommend reviewing it from time to time. Amendments do not limit the rights granted to the Visitor by data protection legislation; if an amendment meant that personal data would be processed for a substantially new purpose requiring consent, VARIANTAI.LT would ask for that consent separately.1.5. The processing of personal data is governed by the General Data Protection Regulation (EU) 2016/679, the Law on Legal Protection of Personal Data of the Republic of Lithuania and other applicable legal acts; this Privacy Policy explains them but does not replace them.1.6. Payments in the online store can be made through the payment service provider Paysera (bank link, payment card), by choosing Inbank financing (purchase in instalments), or by SEPA transfer directly to the VARIANTAI.LT bank account. If Paysera or Inbank is chosen, the data needed to execute and confirm the payment or to process the financing application is transferred to the respective provider, which processes that data as an independent controller under its own privacy policy; the scope of the data processed by Inbank and the financing decision are determined by Inbank itself. VARIANTAI.LT does not receive or store the Visitor’s payment card details or online banking credentials.
2. Data collected by VARIANTAI.LT
2.1. The Website can be browsed and goods can be purchased without registering — an order can be placed as a guest. The Visitor may choose to register and create an account (for example, to see their order history); in that case they provide the data requested in the fields of the registration or order form, for example an email address, name and surname and, in order to fulfil an order, a contact phone number and a delivery address (hereinafter — the Data). The password for an account is generated automatically by the Website.2.2. VARIANTAI.LT processes the data provided by the Visitor and otherwise collected about them only for the purposes set out in this Privacy Policy and only to the extent necessary for those purposes; it uses that data for a new purpose incompatible with the original one only where it has a separate legal basis (for example, the Visitor’s consent).2.3. Data collected when the Visitor completes the registration procedure and/or uses the Website and/or the Services is divided into:2.3.1. Anonymous data. VARIANTAI.LT collects anonymous data relating to facts that cannot be attributed to an individual Visitor. For example, VARIANTAI.LT collects certain information each time a Visitor visits the Website in order to improve the browsing experience. VARIANTAI.LT collects the IP addresses of all Visitors and related data (e.g., the address of the last website the person visited before entering the VARIANTAI.LT portal) and the types of browsers and operating systems (e.g., Firefox browser, Windows OS). VARIANTAI.LT also collects general search expressions from various search engines for internal advertising purposes. VARIANTAI.LT collects this information from all Visitors for the purposes of monitoring and improving the Services and direct advertising. VARIANTAI.LT also collects information about the Visitor’s answers to questions presented on the Websites in order to learn the Visitor’s opinion about the Services and the advertising placed on the Websites. VARIANTAI.LT receives this information from all Visitors, regardless of whether they are registered or not. Where such data (for example, an IP address or a cookie identifier) is considered personal data under the General Data Protection Regulation (EU) 2016/679, the provisions of this Privacy Policy on personal data also apply to it. Cookies and similar technologies are used for statistics and marketing (direct advertising) purposes only with the Visitor’s consent, as set out in Section 4 of this Privacy Policy.2.3.2. Personal data. This is data that can be used to identify a specific Visitor. Within the meaning of the Law on Legal Protection of Personal Data of the Republic of Lithuania, this data is considered personal data. Such data is processed on the following legal bases set out in Article 6(1) of the General Data Protection Regulation (EU) 2016/679 (hereinafter — the GDPR): the Visitor’s consent, where VARIANTAI.LT asks for it (e.g., the consent checkbox in the computer buyback form, consent to non-essential cookies or to receiving direct marketing messages) (point (a)); where this is necessary for entering into or performing a contract with the Visitor, or for taking steps at the Visitor’s request before entering into a contract, e.g., fulfilling an order or answering an enquiry about goods or services (point (b)); where this is necessary for compliance with a legal obligation of VARIANTAI.LT, e.g., keeping accounting records (point (c)); where this is necessary for the purposes of the legitimate interests pursued by VARIANTAI.LT, e.g., answering other enquiries or protecting the Website and its forms against abuse, except where such interests are overridden by the interests or fundamental rights and freedoms of the Visitor (point (f)). The Visitor may withdraw consent at any time by writing to info@variantai.lt, and consent to cookies also by clicking the “Manage consent” button on the Website; the withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. Such data is collected in the following ways:2.3.2.1. Registration and placing an order: to create an account, an email address must be provided. To place an order, the data without which the order cannot be fulfilled must be provided: name and surname, email address, contact phone number and, where the goods are delivered by courier or to a parcel locker, the delivery address. The Visitor may voluntarily provide additional data, for example the company or buyer details needed to issue an invoice, or notes for the order.2.3.2.2. Correspondence and communication: if the Visitor contacts VARIANTAI.LT, VARIANTAI.LT may keep records of such communication and other related information.2.3.2.3. Enquiry forms: when the Visitor submits an enquiry or request through one of the forms on the Website listed in Section 8 below, VARIANTAI.LT processes the data entered in the form as described in that Section.2.3.2.4. VARIANTAI.LT has the right to collect data about the Visitor when they log in to the Website. This data shows which pages of the Website the Visitor visits, at what times and how often, and which services they use. This information also includes data the Visitor submits on the Website.2.3.2.5. Chat window: when the Visitor writes in the PC advisor chat window, the data is processed as set out in Section 9 of this Privacy Policy.2.4. The data subject may at any time contact the administration of the VARIANTAI.LT online store by email at info@variantai.lt and exercise the following rights: to access the personal data processed about them; to have inaccurate or incomplete data rectified; to have the data erased; to have its processing restricted; to object to processing based on legitimate interests, and to object at any time to processing for direct marketing purposes; to receive their data in a structured, machine-readable format and to have it ported (where that right applies); and to withdraw consent at any time. VARIANTAI.LT replies within the time limits laid down by law. The Visitor also has the right to lodge a complaint with a supervisory authority; in Lithuania, this is the State Data Protection Inspectorate (vdai.lrv.lt).
3. Data recipients
3.1. VARIANTAI.LT manages, processes and uses the collected Anonymous data for self-promotion and other similar purposes. Only data from which the Visitor cannot be identified (for example, aggregate statistics) is transferred to third parties or published publicly. Where data is still considered personal data under the General Data Protection Regulation (EU) 2016/679, point 3.2 applies to it.3.2. VARIANTAI.LT processes the collected Personal data in strict compliance with the General Data Protection Regulation (EU) 2016/679 and the Law on Legal Protection of Personal Data of the Republic of Lithuania. VARIANTAI.LT processes Personal data for the following purposes: to establish the identity and contact details of a person purchasing goods on the Website and to fulfil the order (including payment, delivery, warranty service and returns); to create and administer the Visitor’s account on the Website, if they have chosen to create one; to establish the identity and contact details of persons who wish to submit enquiries, complaints and suggestions to VARIANTAI.LT using the forms on the Website; to comply with legal obligations, for example accounting and warranty obligations; to ask, after a purchase, for a review of the goods bought (on the basis of legitimate interests; such emails can be declined in the manner indicated in them or by writing to info@variantai.lt); with the Visitor’s consent, for direct marketing purposes; and for the purposes set out in Section 8 below. Personal data is not sold and is not provided to third parties for their own purposes; however, to the extent necessary for the purposes listed above, it may be provided to: payment and financing service providers (Paysera, Inbank); delivery service providers — courier and parcel locker networks (DPD, Venipak); the Website hosting and email service provider Hostinger; the internal staff messaging platform Discord — when an order has been paid, a notification is sent to a private VARIANTAI.LT channel stating the order number, the amount, the buyer’s first name and surname, the payment method chosen and the list of items ordered; the email marketing platform Omnisend; and, where the Visitor has consented to statistics and/or marketing cookies, the advertising and analytics services of Google (Google Ads, Google Analytics) and Meta (Facebook); as well as accounting, legal and information technology service providers. These parties process the data either on behalf of VARIANTAI.LT and on its instructions (as data processors) or, where legislation imposes independent obligations on them (for example, payment and financing service providers), as independent controllers under their own privacy policies. Data is also provided where this is required by law or where it is necessary to establish, exercise or defend legal claims. Some service providers (for example, Google, Meta and Discord) may also process data outside the European Economic Area. In such cases data is transferred only where a safeguard provided for by law is in place, for example an adequacy decision of the European Commission or standard contractual clauses approved by the European Commission.3.3. The Website may contain active links (“hyperlinks”) to other websites. Some of those websites may collect the Visitor’s personal information, and advertising websites may use cookies and web beacons in their advertisements to collect information about the Visitor. The VARIANTAI.LT Privacy Policy and its provisions do not cover the privacy policies of third parties or their provisions on information collection. VARIANTAI.LT is not and cannot be held responsible for any actions of third parties collecting information about the Visitor.3.4. The data subject has the right to receive information about the data recipients to whom their personal data was provided during the last year.
4. Cookies and web beacons
4.1. The Website uses strictly necessary cookies, without which the Website would not work (for example, cart and security cookies), as well as optional statistics and marketing cookies and web beacons. Optional cookies are used only with the Visitor’s consent, which is requested in the cookie notice shown on the first visit. Consent can be changed or withdrawn at any time by clicking the “Manage consent” button on the Website; strictly necessary cookies are used on the basis of the legitimate interests of VARIANTAI.LT.4.2. A cookie is a small text document with a unique identification number that is transferred from a website to the hard drive of the Visitor’s computer so that the website administrator can distinguish the Visitor’s computer and see the Visitor’s activity online. The unique number identifies the Visitor’s browser each time the Visitor visits the Website. Cookies do not allow websites to memorise any personal information about the Visitor (such as the Visitor’s name and address) that the Visitor might forget to keep private. Cookies allow VARIANTAI.LT to automatically remember the type of the Visitor’s web browser when the Visitor visits the Websites. 4.3. In order to offer the Visitor the best possible quality of services, VARIANTAI.LT uses cookies to:4.3.1. provide products and services in the highest quality and most effective manner. By storing certain information in cookie files or by linking cookies to the registration process, favourite pages or a short description of the Visitor in the VARIANTAI.LT computer system, VARIANTAI.LT can deliver the Services much faster and more efficiently to a larger number of Visitors. This information is usually stored in an encrypted form that only VARIANTAI.LT can decrypt;4.3.2. protect the Visitor against unlawful use of their Data;4.3.3. keep statistics, such as the number of Visitors and traffic. Such information is not linked to the Visitor’s personal information.4.4. The use of cookies is an industry standard, so they are used on most websites. It is possible to prevent cookies from entering the Visitor’s computer or to block all forms of cookies. In that case, some of the Services may work partially or not at all.4.5. Web beacons are small graphic files that VARIANTAI.LT may place on the Websites and in emails that VARIANTAI.LT sends to the Visitor. Together, cookies and web beacons allow VARIANTAI.LT to accurately count the number of unique Visitors on the websites and the number of impressions of the relevant websites. Using web beacons, VARIANTAI.LT can also find out how many times a specific website whose advertisement was sent to the Visitor by email was viewed. Such information is not linked to the Visitor’s personal information.4.6. Any image on the Website may be a web beacon. Third parties advertising on the Websites or in other ways may use web beacons in their advertising.4.7. Since web beacons operate together with cookies, the Visitor can prevent web beacons from collecting their information by setting their browser to reject all cookies, or only the Website’s cookies.
5. Use of Visitor information
5.1. VARIANTAI.LT uses the information collected about the Visitor only for the purposes set out in point 3.2 and Section 8 and only where it has one of the legal bases referred to in point 2.3.2 of this Privacy Policy. The following are examples of the purposes for which VARIANTAI.LT may use information collected about a specific Visitor:5.1.1. to edit the Content in the way most relevant to the Visitor. In some cases, VARIANTAI.LT needs accurate data about the Visitor in order to offer specialised Services and targeted advertising;5.1.2. VARIANTAI.LT accumulates the Visitor’s anonymous data and shares it with third parties (e.g., advertisers). To such parties, VARIANTAI.LT discloses information about the number of Visitors, the number of Visitors who saw a particular advertisement and/or clicked on a particular link on a particular Website, and so on. VARIANTAI.LT may also provide aggregate demographic statistics of those Visitors who noticed and clicked the link of the respective advertiser. VARIANTAI.LT may also disclose anonymous survey results. This process generally does not disclose any of the Visitor’s personal information;5.1.3. VARIANTAI.LT also uses aggregate data for statistical analysis of the general characteristics and behaviour of Visitors in order to identify needs related to particular parts of the Website and to analyse how and where to use available resources most effectively. Without this data, VARIANTAI.LT would not know which parts of the Website are most popular and could not properly modify and edit the Content and the Services offered;5.1.4. VARIANTAI.LT may use the Visitor’s personal information to contact the Visitor and inform them about changed or updated Services, as well as about the Visitor’s accounts or violations of the Terms. If the Visitor participates in games or contests organised on the Website, VARIANTAI.LT may use the Visitor’s information if the Visitor wins and VARIANTAI.LT needs to contact them;5.1.5. VARIANTAI.LT may send emails or postal letters, as well as short messages (SMS) to the Visitor’s mobile phone, with information about Services that, in VARIANTAI.LT’s opinion, would interest the Visitor. The aforementioned information is sent only if the Visitor has given their consent.
6. Security measures
6.1. VARIANTAI.LT uses software and other measures aimed at protecting the Data of all Visitors. Only authorised VARIANTAI.LT employees and/or other persons authorised by VARIANTAI.LT may access the Visitor’s Data.6.2. VARIANTAI.LT asks the Visitor to be careful when using and storing the Data, as the Visitor is personally responsible for the confidentiality of all Data. The Visitor should log out of the browser after finishing work to be sure that no one will access the Visitor’s email or personal information, especially in cases where the Visitor uses a publicly accessible computer (e.g., in an internet café or library). VARIANTAI.LT also warns that the Visitor should be careful and should not disclose their personal information (such as the Visitor’s real name, personal identification number, email address, bank account codes, etc.) to third parties while using the Website and/or the Services. Such information may be used against the Visitor’s interests, including for acts such as fraud, sending unsolicited emails, and the like.6.3. VARIANTAI.LT undertakes to make efforts to protect the Visitor’s personal data processed by VARIANTAI.LT; however, given that the Visitor’s information is transmitted over an internet connection, VARIANTAI.LT warns that it cannot and does not guarantee the security of any information transmitted by the Visitor, including personal data.6.4. VARIANTAI.LT cares about the protection of the rights of minors and restricts their ability to use certain Services intended for adults only. Therefore, separate parts of the Website may be intended for adults only. Minor Visitors are strictly prohibited from entering such parts of the Website. The Visitor is also responsible not only for their own conduct on the Website but also for the conduct of their minor children or other persons under their care, if they use the Website in the Visitor’s environment, with their permission, or using the Visitor’s hardware.
7. Software used on the Website and its installation
7.1. The Website is used through a web browser — VARIANTAI.LT does not provide and does not require the installation of any software or application for the Visitor to browse the Website or to submit an enquiry or an order. Should such software be offered in the future, the terms of its use and of the related data processing would be provided separately, before it is installed.
8. Enquiry forms
8.1. The Website has the following enquiry forms, in which the Visitor provides the following data: the contact form — name, email address, subject and message; the PC maintenance enquiry form — first name, last name, email address and, optionally, a message; the PC rental enquiry form — first name, last name, email address and, optionally, a message; the computer buyback form — first and last name, email address, the category, name or model, condition and description of the item offered, the asking price and, optionally, a phone number, technical specifications, photos of the item and whether the price is negotiable; the back-in-stock notification form (shown on the pages of products that are currently out of stock) — email address.8.2. VARIANTAI.LT uses the data entered in a form only to review and answer the Visitor’s enquiry (for the buyback form, to assess the item offered and make an offer; for the back-in-stock notification form, to send a one-time email when the product is back in stock) and to communicate further with the Visitor about that enquiry, and keeps it only for the period set out in point 8.5 below. This point applies notwithstanding points 2.2 and 5.1 of this Privacy Policy, and the purposes set out in it are in addition to the purposes listed in point 3.2 for processing Personal data. To protect the forms against spam and abuse, technical data (e.g., the IP address) is also used briefly when an enquiry is submitted.8.3. Legal basis: data from the contact, maintenance, rental and back-in-stock notification forms is processed where this is necessary for taking steps at the Visitor’s request before entering into a contract or for performing a contract (Article 6(1)(b) GDPR) and, where the enquiry is not related to a contract, on the basis of the legitimate interest of VARIANTAI.LT in answering enquiries addressed to it (Article 6(1)(f) GDPR). Data from the buyback form is processed on the basis of the Visitor’s consent, given by ticking the consent checkbox (Article 6(1)(a) GDPR); consent may be withdrawn at any time by writing to info@variantai.lt. Technical data used to protect the forms is processed on the basis of the legitimate interest of VARIANTAI.LT (Article 6(1)(f) GDPR). The Visitor is not obliged to provide the data, but an enquiry cannot be sent without filling in the mandatory fields of the form, and without this data VARIANTAI.LT could not answer it.8.4. Recipients: enquiries from the contact, maintenance, rental and buyback forms are delivered by email to the VARIANTAI.LT mailbox info@variantai.lt, and the email address entered in the back-in-stock notification form is kept in the Website’s database with that product until the notification is sent. Copies of the emails sent by the Website, including enquiry emails and back-in-stock notifications, are also kept in the Website’s technical log of sent emails. Enquiries are accessed only by the VARIANTAI.LT employees who handle them and by other persons authorised by VARIANTAI.LT. The Website’s hosting and email service provider, Hostinger, processes this data on behalf of VARIANTAI.LT and on its instructions (as a data processor). Form data is provided to other persons only where this is required by law.8.5. Retention: form data and the correspondence related to an enquiry are kept for as long as they are needed to review the enquiry and complete the related communication; the email address entered in the back-in-stock notification form is removed from the product’s waiting list when the notification is sent. If a contract is concluded following the enquiry (e.g., an order, a rental or the buyback of an item), the correspondence may be kept for as long as the documents related to that contract are kept, or for as long as it is needed to establish, exercise or defend legal claims. When the data is no longer needed for these purposes, or when the consent on which its processing is based is withdrawn, the data is deleted, unless a longer retention period is required by law.8.6. Rights of the Visitor: the Visitor has the rights set out in point 2.4, as well as the right to restrict the processing of their data, the right to object to processing based on legitimate interest, the right to data portability (where applicable) and the right to withdraw consent at any time. Requests to exercise these rights may be sent by email to info@variantai.lt. The Visitor also has the right to lodge a complaint with a supervisory authority; in Lithuania, this is the State Data Protection Inspectorate (vdai.lrv.lt).
9. PC advisor chat window
9.1. The Website has an automated PC advisor chat window in which the Visitor can describe in free text what kind of computer they need (for example, the games they play and the budget they have in mind), and the Website immediately shows matching products that are in stock. The answers are assembled by the Website itself, from pre-written texts and product data, on the basis of the text the Visitor has typed; the chat is not a conversation with a VARIANTAI.LT employee.9.2. Data processed and purpose: the text the Visitor types into the chat window and technical request data (for example, the IP address) are processed in order to show products matching the Visitor’s needs and to protect the chat window against abuse (the number of requests from one IP address is limited). No personal data is needed or requested in the chat window, so please do not type your name, contact details or other personal information into it — if you would like a person to contact you, please use the contact form or write to info@variantai.lt. If the Visitor does type personal data anyway, it is processed as described in this Section.9.3. Legal basis: the legitimate interests of VARIANTAI.LT in helping the Visitor choose a product and in protecting the Website against abuse (Article 6(1)(f) GDPR).9.4. Recipients: the chat text is processed on the Website’s server; it is technically processed by the Website’s hosting service provider Hostinger on behalf of VARIANTAI.LT and on its instructions (as a data processor). At present the chat text is not provided to any other recipients and is not used to train artificial intelligence models. Should an external service be used in the future to recognise the topic of the Visitor’s question, this Privacy Policy would be updated and that recipient named in it before such use begins.9.5. Retention: the chat history is kept only in the Visitor’s browser and disappears when the page is closed or reloaded; the chat text is not stored on the Website’s server — only a technical identifier (a hash value) calculated from the Visitor’s question is stored there. For technical purposes the answer prepared by the Website and a request counter are stored temporarily (for no longer than 12 hours) and expire automatically.
